At fault driver's car insurance won't pay for my damages!?

Hey guys and gals, My wife was in a car accident on 10/8 driving our truck with liability only insurance (IE: not full coverage because the truck is only worth ~$3000 and it's paid for). She was turning right and had slowed down to turn (with her turn signal on) when a speeding truck slammed into the van behind her, ramming the van in to our truck. The police filed a report, in which the driver of the speeding truck (an 18 year old kid, that had just left his house less than 1/4 mile away) was determined to be at fault. It is worth note that this happened in front of two different auto body shops, and within sight of the house the at fault driver had just left. Their insurance company, state farm, finally contacted us on 11/8 after not returning our phone calls for nearly two weeks saying they had determined he was in fact at fault and would send an adjuster the following Monday. He came, inspected the truck, determined it was repairable, then said we would hear from their office later that day. When they called they told us the damage was more than 75% of the vehicles worth so it was considered total and they would send the required paperwork to my email address to begin payment. Within 3 hours, the claim agent we had talked to the previous Friday said an owner of one of the auto shops had came forward (all of a sudden, no mention of a witness before) and that he had a notarized statement saying the van struck our vehicle before the truck struck the van. The insurance company now will not pay us for the damages. We tried to call the witness and get a copy of his report because State Farm would not give us the copy. Then we called the other auto body shop and both the owner and one of his employees both seen the accident and say that the truck was at fault, and the owner overheard the driver say specifically that it was his fault. When we bring this to the agents attention, she claims this is not evidence because they know the at fault driver. We found out that the first witness also knows the driver, but can't prove it. Ours is a small town, you don't have neighbors that you don't know or speak to. It seems we are at an impasse, and I have been without a truck for nearly 6 weeks. What should I do in this instance? Get an attorney? Our insurance agency is adamant about not intervening since we did not have full coverage insurance. It may be worth noting that my wife has had back and neck pain since the accident and went to the hospital the day of the accident, the family doctor twice since, and has an appointment with a chiropractor next week (all of which our insurance has paid for.)

I've been with State Farm since the 1970's, but am a member of AAA. I was going to take my State Farm papers down to the AAA office and see if they could give me a better rate. My question is, does anyone have any experience with AAA car insurance? Good or bad, I'd like to hear about it.

After the repair is completed, a receipt will be issued and signed by both parties. I am not a lawyer, I just wonder will there be any catch on this? On the morning of Sept 14, 2011 my sister woke me up at home asking me where my car was. I went outside to discover my vehicle was gone. So I call the police to come and take a report but of course there wasn't enough officers on duty to send one out so I wake up my brother to get a ride to the station. Keep in mind this is between 2:30-5:00am and the last time I actually saw my car was Sept 13, 2011 at approx 11pm. I arrive at the police station where I make a report, they take down all the info and send me home with the report. Approx 1 hour later they call me and say my vehicle was recovered in a nearby city and they gave me the number to that police station. So I hurry to call them but of course they were closed until 8am. At 8am I call them they said bring my ID and insurance info to recover the vehicle. I go down there and ask questions but they told me they weren't allowed to disclose any information about who, what, were, or when the incident occurred because of confidentiality. They told me I would have to pay the towing and storage fee to recover my car from the impound. So I left and went to the impound paid $218.00 to discover that my vehicle had been totaled. So I had it towed to my house where I called the insurance company to report this. After I reported this incident they took a recorded statement and gave me a claim number. I waited for 2days for my adjuster to call me back and he never did. about 2 weeks later my adjuster calls and leaves me a message saying he needed another recorded statement and to call him back. I call back and got his voice mail. I spoke to one of his colleagues and they said they would send him and his manager a memo to call me back..well that never happened. 1 week after that I get a packet in the mail asking for my cell phone records, keys to the vehicle, and a notarized affidavit. I sent these things back and then a detective from the insurance company calls me and said there were red flags and he needed to get a video recorded statement. I agreed and went to give the statement. A few days later a detective from the police department where my car was recovered from calls me and tells me that my youngest son's father was with some friends at a nightclub were a drive-by shooting occurred and my son's father wasn't shot but the young man he was with was and as a result of them trying to escape the scene my car was crashed. As they arrived to the scene and asked questions about what happened my son's father would not admit he was driving the vehicle, and because they didn't actually see him driving or pull him over they could not prosecute. The detective asked me did I know anything about this incident and I replied hell no! The night of the incident my son's father had came to my house around 3am but never mentioned anything of course because he knows I would have tried to kill him. He also knows I would have been pissed because I never let him drive my car for the 3 years that I have known him, he has never had a license. She ask me was it ok to list him as a suspect and I told her Yes! I let her know that he did not have permission to drive my car under any circumstances. The very next day the detective from the insurance company called me and ask me what was my son's father name and what where the numbers that where called on my cell phone records. He asked why did he call me at 2:54am, I explained he wanted to let me know he was on his way over which wasn't out of the ordinary for him to do. So then the detective tells me my story stinks and I need to withdraw my claim because on my interview I didn't disclose that my boyfriend had come to my house. I told him why did I need to disclose who was sleeping in my bed if it had nothing to do with my car. I mean we know now he had something to do with it but I didn't know then. He told me the police detective also had the keys to my car which was a lie. It clearly states on the impound record that they had no keys. Not to mention the car has broken locks and loose wires I guess he didn't read that part of the report. He also told me I was trying to cover for my son's dad to get the car covered. I told him he could arrest him for GTA for all I care. My car was stolen and no matter who stole it I'm the victim and of course I want my car covered. He then said he was denying the claim and sending the case to the Department of Insurance to see if fraud was committed. Im beyond frustrated because I have nothing to do with what my son's dad did. Should I sue?

I'm almost 20 years old, a full time student and do not have health insurance. When I was 16, my parents switched insurance companies, and for some reason or other they did not put me on their policy. So I have not had insurance for 3 years. In February I found out I was pregnant so I began applying for Medicaid. Before all the paperwork was done, I had miscarried and in the process racked up almost $6000 in medical bills. I went to the medicaid office and they told me that they would cover my bills even though I was no longer pregnant and college students don't qualify. After 2 months of waiting, Medicaid denied me and the hospital turned me into a collection agency. I was denied because I make too much money. I make $8.55 an hour and work about 15 hours a week. Yes I do make good money for a student but I have worked at the business for 3 1/2 years. Because I am not a full time employee, I don't qualify for insurance, but only managers and department heads are full time. I can't get a second job to help pay the costs because my first job wont work around another one, and I can't find a full time job because no where is hiring. Plus it would be very hard to find anywhere that pays as well as the job I have here. So if health insurance is so important to have, then why is it so hard to obtain?

Two years ago a girl rode her bike into my car as I pulled into my driveway. There was no damage to my car but she fell as a result of it and called her mother who asked for my insurance information. The police came and after the girl and her mother filed a police report, deemed that it was her fault for a) riding on the sidewalk and b) for not stopping when she saw the car because i was already mostly in and witnesses could prove that. Anyways, today I was shopping around for a new insurance quote when I was told they couldn't offer me coverage as I made a claim in 2010. This is the only incident that happened that year. Now, my insurance provider never informed me that a claim had been made. My premium went up but when I asked all I was told was that they had yearly increases. Is it their legal obligation to inform me if a claim has been made. If so, what are my next steps to a) clear this up and b) take action against my insurance company?

A couple of months ago I got pulled over doing a 37 in a 25. The cop was nie and let me go with a WRITTEN warning. Weeks later someone totaled my car while it was parked. I recently got a new car and the 1st payment was only $120 something and that was ear our estimated quote, but for the past 2 payments the price has been over $200 dollars and my mother is convinced that my insurance company saw the WRITTEN warning and thats why my rates went up. Is it true that this thing can happen? From my research and understanding insurance companies don't hardly ever do this and thats why is was a warning. I have been told that if I am planning on getting pregnant I have to have a maternity rider for an extra 100 dollars a month. If I become pregnant without it they will not cover my pregnancy. Hello, I just paid my car insurance......the lady said I should get my own insurance so I can start getting my own discounts , I am 30 years old and both my sisters (32 and 28) are on my mom and dad's insurance plan too, we get a multi line and multi car discount that adds up to about $40 dollars every 6 months for me.....I was in a hurry so I didn't really ask why but was wondering about it after I left.....I pay $112 every 6 months so $40 extra would be kind of crazy wouldn't it? Just wondering why......thank you.......

A few months ago my dad had a fire at his house. In the middle of restorations, his insurance company dropped him. I was in a low-impact car accident and went to the ER the next day to get checked up just incase. I went to my doctor because of back pain and when I mentioned I was in a car accident. They told me I could not go through my health insurance that it has to be through my car insurance. It turns out I have herniated discs and now my doctor has referred me to see an orthopedic surgeon but, I do not feel that the car accident was the cause of the herniated discs. I asked again if I can treatment through my health insurance and I was told by one of the office assistants that it is fraud if I use my health insurance. If I explain to my doctor that I fell down the stairs and insist that I do not want to through through my car insurance because I do not feel the car accident was the cause will he change his mind and refer me to the specialist using my health insurance or should I go through another doctor.

Audatex is not kelly blue book they look at craigslist & not the dealer. Craigslist sometimes has cars where a mechanic might not catch it but is damaged. Problem with car insurance?

This isn't my car. So sorry if I'm fussy on details. Basically in the snow a car lost control of their car and crashed into my friends car. Which was parked up. They were decent and called their insurance company. Unforcantly there's a problem with the door that needs to be replaced. They said they will give her 600 and she has to cover the rest. Surely it all should be paid by their insurance not just some of it? Her father wants to demand money off the bloke which I don't thinks right. My boyfriend crashed his friend's car recently. He had permission to drive it but happened to get into an accident. Ok, so this is a little complicated... Oct 2008 I had a car accident. My car was written off. My car was towed to a garage and was held there while the insurance company evaluated the damage. THAT WAS THE LAST TIME I SAW MY CAR. Because the size of my excess (800) and the amount of damage matched the value of the car (800) I was advised it would be pointless to claim on the insurance and it was written off. The accident was my fault and I held my hands up and admitted it and the other party walked away with everything sorted. No suggestion of fraud and certainly nothing fraudulent on my part. Towards the end of 2008 my insurance company started falling off the radar, not returning my calls or my emails, letters etc. I repeatedly asked what I was supposed to do next (I'd never had an accident before and the whole process confused me because they kept giving me conflicting info) and where my car was. I was ignored (or given incorrect info). In the end I declared a SORN on the car and had so much going on in my personal life, I forgot about it, knowing the car was off the road. Anyway, I'm now trying to track the car down as the SORN is about to run out. Insurance company are still off the radar and refusing to answer. Now they're saying they have no record of me, my policy OR my car. So I've lost my car, I don't know who's got it and yet I'm still liable for it. What can I do? Can I get the police involved? Trading standards? ANYTHING? I don't care about the car, whoever has it can keep it! I just don't want to be liable for it! By the way, the insurance company involved is SwiftCover.com, in case anyone is thinking of going with them because they're cheap. They're cheap because they're RUBBISH.

I have been considering purchasing an older car for about a year. I've done a little research during that time and narrowed down what I want. Last week, I found a car that I really like, a '62 Lincoln. However, I have some concerns about having a car like this and wanting to get some feedback from someone with the knowledge/experience/wisdom in this area. Firstly, I am not rich and getting this car would mean borrowing money. My intent was to sell my current car once I have this car to cover most of the cost of the classic. Would that be a mistake? My current car is paid off, so money-wise it would be a question of insurance costs and taxes/tags every year (if I were to keep my current car). Second, the car I'm looking at is pretty authentic, meaning it has almost all its original parts and accessories. Would it be a mistake to modify it? I mean, repainting it (down the road), having the upholstery redone, installing a current radio and speakers, putting on modern-style tires, etc. Will this change its value negatively? I do like the car as it is, but I'd really like to put modern-style tires on it and put in a modern stereo, at least. Repainting and such would be probably 5+ years down the road, if I decided to do this. Probably, I'd want to reupholster the seats before painting it. And, since I am not rich nor a moneyed individual, I don't have a storage place to park it at my place. I mean, I have a garage, but my house is old, the garage is narrow, and I use it as my workshop. If I were to park the car in it, that would be I'd have to pack up my workshop and remove the shelves to make it fit. Do I need to keep it in a garage? Would that be smart? Does it matter since it's intended to be my primary vehicle? I can't think of anything else to ask at the moment, so if you have any other advice or insights, I'd certainly appreciate them!

ok so i was driving my brothers car and i have my g1 i went to money mart and back home about an hour later police came knocking on my door asking if my brother was in a car accident so we went down to the station and the officer asked if i was driving his car i said yes , he then said that the other man that was sitting in the station got my plates and said i hit his car and cracked his bumper (very minor crack) so i said no and then officer assumed i was lying and made me write up an accident report. after when i was leaving the station the other guy asked if we could solving this without going through insurance so we exchanged numbers (their was no damage at all to my brothers car & no paint or anything on their car to prove i hit it) the next day they called and said the want a whole new bumper they dont want it patched up and they would get me a price quote they then got me a quote for $1475 for a while new bumper from ford i told them im not paying that much the only way im replacing the bumper is if my mechanic does it he said ok so i went to my mechanic told him the whole situation and he said i shouldnt be replacing the whole bumper for somthing that small but he still ordered the bumper for me i had to put a $400 down payment for the bumper and $300 after its put on. the bumper came in 2 days later and they brought their car for it to be put on when we got there they got pissed off and said this isnt a bumper straight from ford and they dont want it and left ( the bumper was brand new for the same model car and had the exact paint coat match just that it wasnt from ford) they then call me threating to take it through insurance if we dont get it from ford so i lost the $400 down payment for the bumper because they cant return it after its painted so i told my mechanic to order it from ford. but when he called for they said the dont have bumpers for that model anymore, i then call the people back and told them to take it through insurance because my mechanic cant get that bumper. So what will happen to my brothers insurance hes under 25 with his g2, and i had my g1 but it was on private property where they said the incident occurred the officer even said he cant charged me because its private property PLEASE HELP!

okay im 19 livin in MICHIGAN. My driving record sucks, (2) accidents i got rear ended, (3) speeding tickets a total of 7 points license is restricted till jan, 2012. I want a car but its around 600-900$ a MONTH to insure me, 99 dodge neon to a 2010 mustang gt all the same price a month depends what insurance company. i cant be on my parents insurance because they excluded off their policy. I allso live in a apartment, so is it possible to buy a insurance policy in my moms name with her correct sos number and drivers license number and lie and say she lives with me in my appartment and put me as a secondary driver. but the car ill be fiancing so i need full coverage and the car is in my name . My questions are (A) my mom uses lifelock will she find out that i opened a policy in her name. (B) will the insurance company find out about that my mom doesnt live their or would they find out at all. AND MY MOM LIVES AT A ANOTHER ADDRESS. (C) is it legal to own and fiance a car thatS in my name but insurance is not ill be listed as a seconday driver under my mom . (d) my mom WOULD NOT KNOW IM DOING THIS. I KNOW THATS FRAUD BUT U GOT TO DO WHAT U GOTTA DO how would anyone know what im doing and find out about it
